The facts are not in dispute. In 1981, the Wastewater Management Division (Division) of the Denver Department of Public Works commenced construction of a sanitary sewer line beneath East 56th Avenue between Chambers Road and Towers Road as part of a 1973 annexation agreement between Denver and a private developer of the Green Valley Ranch subdivision.
